By downloading or using Abidence (the "App"), you agree to these Terms of Service. If you do not agree, do not use the App. Abidence is published under a single, independent Apple Developer account (Team ID ZM8LF8494F); "we," "us," and "our" mean that developer.
Abidence is a private, on-device evidence diary for people who believe they experienced housing discrimination while renting, buying, or seeking a home loan. You record incidents in your own words — a date and time, the party involved, what happened, their verbatim quotes, written materials they referenced, witnesses, and optional protected-class tags you may leave blank. The App organizes those entries into a case timeline, shows you the federal Fair Housing Act and your state's fair-housing reference, counts down the HUD and DOJ filing windows, and (for Pro) generates evidence documents for your own use.
The App is free to download and use. The free tier records up to 10 incidents per case (with every field), and includes the full read-only case timeline, the complete Fair Housing Act and 50-state reference, the live HUD one-year and DOJ two-year deadline countdowns, and App Lock. App Lock is included free for all users.
Pro features unlock when you start the Pro subscription or complete the Lifetime purchase. Two products are offered:
Both products unlock the identical Pro feature set. Prices shown are USD; Apple displays the equivalent local price at purchase time. There is no monthly product.
The Annual subscription automatically renews until canceled. Renewal is charged within 24 hours before the end of the current period unless auto-renewal is turned off at least 24 hours before that end. Payment is charged to your Apple ID. You can manage and cancel your subscription in Settings > [your name] > Subscriptions on your iOS device. Refunds for the unused portion of an active period are not offered by us; refund eligibility is determined solely by Apple under its published policies. The Lifetime purchase is a single charge with no recurring billing.
If you start the 14-day free trial on Annual and cancel during the trial, you keep Pro access through the end of the trial and are not charged. If you do not cancel, your subscription begins at the end of the trial at the published price.
Pro provides the following features. The behavior described here is binding on us — if a future App update materially changes any of these descriptions, we will revise this section.
App Lock is a Free feature that uses Apple's LocalAuthentication framework (Face ID, Touch ID, or device passcode) to gate access to the App. Biometric data never leaves Apple's Secure Enclave; the App receives only a success/failure result. App Lock can be enabled or disabled in Settings > Privacy at any time.
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the App is limited to the amount you paid us, through Apple, in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost data, missed filing windows, the outcome of any complaint or lawsuit, or any housing or financial outcome. Reference content, deadline calculations, and generated documents are tools for your use; we do not guarantee that HUD, any agency, or any court will accept or be bound by them.
Your use of the App is also governed by Apple's standard End User License Agreement (EULA) for licensed applications, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of a conflict between these Terms and the Apple EULA, these Terms govern as between you and us; the Apple EULA governs as between you and Apple.
All organization and agency names referenced in the App and in this document — including the U.S. Department of Housing and Urban Development (HUD), the U.S. Department of Justice, and the National Fair Housing Alliance — belong to their respective holders. Abidence is not affiliated with, endorsed by, or connected to any listed entity.
We may update these Terms from time to time. Material changes will be surfaced in the App on next launch. Continued use of the App after a change constitutes acceptance.
These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles. Disputes will be resolved in courts located in California, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.
