1. Acceptance of terms

By installing or using Custody Journal, you agree to these Terms of Service. If you do not agree, do not install or use the app.

2. Description of service

Custody Journal is an iOS application that helps a single parent document custody exchanges, log a child's wellbeing, archive communications with the other parent, track child-related expenses, and generate a court-ready PDF evidence package. All data is stored on the user's device. The app has no backend, no account system, and no cloud synchronization.

3. Free tier and Pro tier

The free tier of Custody Journal includes one child profile, up to 20 custody exchange entries per calendar month, basic notes on each exchange, calendar and list views of exchanges, a parenting time calculator, exchange reminder notifications, and Face ID / Touch ID app lock.

The Pro tier unlocks the following additional features: multiple children, unlimited monthly exchanges, Child Wellbeing Journal, Communication Archive, Expense Tracker with receipt photos, Violation Dashboard, GPS verification on exchanges, the Court-Ready PDF Evidence Package generator, CSV export, home screen widget, and photo attachments on wellbeing entries, communications, and expenses.

5. Appropriate use

You agree to use Custody Journal only for your own personal documentation of your family situation. You are responsible for the accuracy of the records you enter. Do not enter false information intended to mislead a court, attorney, or third party. Do not use Custody Journal to harass, threaten, or surveil any individual.

6. No legal representation

Custody Journal does not provide legal services. The Court-Ready PDF Evidence Package is a formatted summary of the records you entered. It is not a court filing, not a sworn document, and not a substitute for professional legal work product. You should have any document reviewed by a licensed attorney before submitting it in any legal proceeding.

7. Data responsibility

Because Custody Journal stores all data on your device, you are solely responsible for backing up your device. We recommend enabling iCloud Backup. The developer of Custody Journal is not responsible for data loss resulting from device damage, device loss, operating-system errors, or user deletion.

8. Disclaimer of warranties

Custody Journal is provided "as is" without warranty of any kind. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that defects will be corrected.

9. Limitation of liability

To the maximum extent permitted by law, in no event will the developer of Custody Journal be liable for any indirect, incidental, special, consequential, or punitive damages, including damages for lost profits, lost data, or outcomes in any legal proceeding. In no case will total liability exceed the amount you have paid in Custody Journal subscription fees in the twelve months preceding the event giving rise to the claim.

10. Changes to terms

We may update these Terms of Service from time to time. The revised version will be posted at the same URL. Continued use of the app after any update constitutes acceptance of the revised terms.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which the developer is resident, without regard to conflict-of-law provisions.
