Discloze Terms of Service

These terms are the agreement between you and the independent developer of Discloze (Apple Developer Team ID ZM8LF8494F). By using the app you accept them. If you do not agree, please do not use Discloze.

Read this first. Discloze is a record-keeping and reference tool for real estate agents. It is not a law firm, it does not provide legal advice or representation, it does not determine whether an error or omission occurred, and it does not predict how any claim will turn out. Your records are statements you wrote, not proof of any fact. For advice about an actual or potential E&O claim, consult a real estate attorney and notify your E&O insurer.

What Discloze does

Discloze lets you record, per real-estate transaction, the disclosure actions you took, the communications you had, and any claim that arises, and to browse a reference of state disclosure and fiduciary-duty obligations. Everything you enter is your own account of events, stored on your device. Discloze does not verify your entries, file anything, or contact any party on your behalf.

You are responsible for the accuracy of what you record and for meeting your actual professional and legal obligations.

Sensitive data you agree not to enter

Discloze is built to hold property-transaction facts and your own disclosure and communication actions only. You agree not to enter a client's financial account numbers, Social Security number, banking details, or health information. Identify clients by initials. The app provides no field for, and is not designed to hold, that information.

Your records and your device

All data is stored locally on your iPhone and is included in your standard iOS Backups when you enable them. There is no Discloze server and no remote copy. If you delete the app without an available iOS Backup, your records cannot be recovered. There is no in-app export, import, or backup feature; the one document the app produces is the E&O Defense PDF you choose to generate and share.

Free features and the Pro subscription

Discloze is free to use for up to two transactions, with up to ten disclosure actions each, including the communication and claim logs within those transactions, the full state disclosure and fiduciary-duty reference, and the directory of free professional alternatives. Discloze Pro is an optional subscription that adds the following:

Billing

Discloze Pro is offered as a monthly subscription at $14.99 and an annual subscription at $89.00 with a 7-day free trial, purchased through Apple. Payment is charged to your Apple Account at confirmation of purchase, and for the annual plan after the free trial ends. A subscription renews automatically unless you cancel it at least 24 hours before the current period ends. Any unused portion of a free trial is forfeited when you purchase a subscription. You manage or cancel a subscription in your Apple Account settings; Apple, not Discloze, processes all payments and refunds.

The state reference is informational

The state disclosure and fiduciary-duty content is drawn from publicly available regulations as of the App Store release date and is provided as general reference, not legal advice and not a statement of your obligations in any specific matter. Laws change and vary by jurisdiction and transaction. Confirm your current obligations with a real estate attorney or your state real estate commission before relying on anything in the app.

No warranty

Discloze is provided "as is," without warranties of any kind. The developer does not warrant that the app is error-free, that records will satisfy any insurer, board, or court, or that the reference content is current or complete. You use the app at your own risk.

Limitation of liability

To the maximum extent allowed by law, the developer is not liable for any indirect, incidental, or consequential damages, or for any loss of data or loss arising from a claim's outcome, arising out of your use of Discloze. The developer's total liability is limited to the amount you paid for the app in the twelve months before the claim.

Changes

These terms may be updated as the app changes. Material changes will be reflected by the "Last updated" date above and, where appropriate, surfaced in the app. Continued use after a change means you accept the updated terms.
