GlucoCompanion Terms of Service

1. Acceptance

By downloading or using GlucoCompanion (the "App"), you agree to these Terms of Service. If you do not agree, do not use the App. The App is published by Flint Software, an independent iOS developer (Apple Developer Team ID ZM8LF8494F); references to "we," "us," and "our" mean that developer.

2. What GlucoCompanion is — and what it is not

GlucoCompanion is a personal records organizer with insurance reference content and a deterministic appeal deadline calculator. You enter information about your diabetes profile, your prior authorization (PA) and appeal encounters, and your manufacturer Patient Assistance Program applications. The App helps you organize that information, look up reference content (Medicare LCD/NCD criteria, Medicaid 50-state coverage rules, manufacturer PAP eligibility), compute appeal deadlines, and generate PDF reports for your own use.

GlucoCompanion is not a glucose tracker, an FDA Class II medical device, an endocrinologist, a Certified Diabetes Care and Education Specialist (CDCES), an insurance attorney, an insurance broker, or a government benefits worker. The App does not predict glucose values, calculate insulin doses, count carbohydrates as medical advice, interpret time-in-range, estimate A1C, recommend pump settings or CGM alarms, advise on PA strategies, recommend specific attorneys, or predict approval outcomes. All clinical decisions about insulin, glucose, carbs, pumps, and CGMs must be made with your endocrinologist or CDCES. All legal decisions about lawsuits, ERISA litigation, or ADA discrimination must be made with a licensed attorney. All insurance advocacy questions should be directed to ADA, JDRF, Beyond Type 1/2, Patient Advocate Foundation, Patient Access Network Foundation, SHIP (free Medicare counseling, all 50 states), or your state insurance commissioner via NAIC.

3. Subscriptions and the Pro tier

3.1 Free tier

The App is free to download and use, with the following limits: 1 Diabetes Profile, 10 PA / Appeal Encounter entries, read-only Reference Mapper lookup, the basic 8-organization Patient Advocacy directory (ADA, JDRF, Beyond Type 1, Beyond Type 2, PAF, PAN, SHIP, NAIC), 6 of 22 encounter category types, and a basic Encounter Summary PDF report.

3.2 Pro tier

Pro features unlock when you start a Pro subscription or complete the Lifetime purchase. Two products are offered:

Pro Annual — $29.99 per year, with a 14-day free trial for first-time subscribers.
Pro Lifetime — $149 one-time, non-consumable in-app purchase, no auto-renewal.

Both products unlock the identical Pro feature set. There is no monthly subscription — diabetes is a multi-year journey, and PA cycles do not fit monthly cadences. Prices shown are USD; Apple displays the equivalent local price at purchase time.

3.3 Auto-renewal and billing (Annual only)

The Annual subscription automatically renews until canceled. Renewal is charged within 24 hours before the end of the current period unless auto-renewal is turned off at least 24 hours before that end. Payment is charged to your Apple ID. You can manage and cancel your subscription in Settings > [your name] > Subscriptions on your iOS device. Refunds for the unused portion of an active period are not offered by GlucoCompanion; refund eligibility is determined solely by Apple under its published policies. The Lifetime purchase is a single charge with no recurring billing.

3.4 Free trial forfeiture

If you start the 14-day free trial and cancel during the trial, you keep Pro access through the end of the trial and are not charged. If you do not cancel, your subscription begins at the end of the trial at the published price.

4. Pro features

Pro provides the following features. The behavior described here is binding on us — if a future App update materially changes any of these descriptions, we will revise this section.

Appeal Deadline Calculator: Computes appeal deadlines using deterministic, rule-based logic from publicly available federal and state regulations (29 CFR 2560.503-1 for ERISA, 42 CFR 405.940 et seq for Medicare, individual state Medicaid agency rules). Deadlines are informational and not a guarantee of correctness for your specific case. Consult a licensed attorney or your state insurance commissioner for binding determinations.
Medicare LCD / NCD Reference: Reference content is drawn from publicly available Centers for Medicare and Medicaid Services (CMS) Local and National Coverage Determination policies. Coverage criteria change. References do not constitute medical or legal advice.
Medicaid 50-State Coverage Reference: Reference content is drawn from publicly available state Medicaid agency policies as of the App Store release date. State policies change frequently. References do not constitute medical or legal advice.
Manufacturer PAP Cross-Map: Reference content is drawn from publicly available manufacturer Patient Assistance Program eligibility criteria. Programs change. References do not constitute eligibility determination.
HealthKit Display: With explicit user permission, reads Blood Glucose, Insulin Delivery, Carbohydrates, and Body Mass from HealthKit for display only. GlucoCompanion does NOT interpret glucose values, predict outcomes, calculate insulin doses, or provide clinical recommendations. No HealthKit data is transmitted off-device.
PDF Evidence Reports: Files generated on-device by PDFKit. No encounter content is transmitted during PDF generation. Reports include the standard GlucoCompanion footer disclaimer.
Appeal Letter Templates: Reference-only templates that must be reviewed and completed by the user. GlucoCompanion does not auto-generate letter content and is not a legal service.
Complete Encounter Categories: All 22 encounter type categories are stored as local taxonomy strings on the user's encounter records.
App Lock: Uses LocalAuthentication. Biometric data never leaves Apple's Secure Enclave; the app receives only a success/failure result.

5. Your responsibilities

You are responsible for the accuracy of every value, deadline, carrier name, plan detail, and provider contact you enter.
You are responsible for maintaining iOS Backups (iCloud Backup or Finder/iTunes) so that your records survive device loss. GlucoCompanion has no remote copy of your data and cannot restore it. There is no in-app data export, import, or backup feature.
You will not use the App as a substitute for an endocrinologist, CDCES, attorney, insurance broker, or government benefits worker. You will consult those professionals for all clinical, legal, and binding insurance determinations.
You will not use the App in violation of FDA regulations governing clinical decision support tools or in any manner that could be construed as the unauthorized practice of law (UPL) in your jurisdiction.

6. Disclaimers and limitation of liability

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the App is limited to the amount you paid us, through Apple, for the App in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost data, lost insurance recoveries, denied PA outcomes, missed appeal deadlines, lost Patient Assistance Program eligibility, lost insurance coverage, or any clinical outcome. Reference content and deadline calculations are tools for your use; we do not guarantee that any insurance carrier, government agency, or court will accept or be bound by them.

7. Apple End User License Agreement

Your use of the App is also governed by Apple's standard End User License Agreement (EULA) for licensed applications, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of a conflict between these Terms and the Apple EULA, these Terms govern as between you and us; the Apple EULA governs as between you and Apple.

8. Trademarks

All product, organization, and agency names referenced in the App and in this document — including but not limited to Medicare, Medicaid, ERISA, Eli Lilly, Novo Nordisk, Sanofi, Dexcom, Tandem, Insulet, Omnipod, Abbott, Roche, ADA, JDRF, Beyond Type 1, Beyond Type 2, Patient Advocate Foundation, Patient Access Network Foundation, SHIP, NAIC, Aetna, BCBS, UnitedHealth, Cigna, Humana, and Kaiser — belong to their respective holders. GlucoCompanion is not affiliated with, endorsed by, or connected to any listed entity.

9. Changes to these terms

We may update these Terms from time to time. Material changes will be surfaced in the App on next launch. Continued use of the App after a change constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles. Disputes will be resolved in courts located in California, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.
