By downloading or using HullNote (the "App"), you agree to these Terms of Service. If you do not agree, do not use the App. The App is published by an independent iOS developer (Apple Developer Team ID ZM8LF8494F); "we," "us," and "our" mean that developer.
HullNote is a report-writing and photo-organizing tool for marine surveyors. You enter information about the vessels you inspect and the surveys you conduct. The App guides a survey system by system, lets you attach photos to individual findings with a standardized condition rating, groups a vessel's surveys by the hull identification number you enter so you can compare earlier findings, and generates PDF reports for your own use.
The App is free to download and use, with the following limits: one vessel with unlimited surveys, each with the full guided system-by-system workflow, photo-to-finding binding, and the standardized condition-rating vocabulary; the pre-purchase survey template; and a basic single-survey PDF you can share at any time.
Pro features unlock when you start a Pro subscription or complete the Lifetime purchase. Three products are offered:
All three products unlock the identical Pro feature set. Prices shown are USD; Apple displays the equivalent local price at purchase time.
The Monthly and Annual subscriptions automatically renew until canceled. Renewal is charged within 24 hours before the end of the current period unless auto-renewal is turned off at least 24 hours before that end. Payment is charged to your Apple Account. You can manage and cancel your subscription in Settings > [your name] > Subscriptions on your iOS device. Refunds for the unused portion of an active period are not offered by us; refund eligibility is determined solely by Apple under its published policies. The Lifetime purchase is a single charge with no recurring billing.
If you start the 7-day free trial on Annual and cancel during the trial, you keep Pro access through the end of the trial and are not charged. If you do not cancel, your subscription begins at the end of the trial at the published price. Any unused portion of a free trial is forfeited when you purchase a subscription.
Pro provides the following features. The behavior described here is binding on us — if a future App update materially changes any of these descriptions, we will revise this section.
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the App is limited to the amount you paid us, through Apple, for the App in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost data, an inaccurate or incomplete report, a missed finding, or any commercial, insurance, financing, or legal outcome arising from a survey. The App is a documentation tool for your use; we do not guarantee that any client, bank, underwriter, or court will accept or be bound by a report produced with it.
Your use of the App is also governed by Apple's standard End User License Agreement (EULA) for licensed applications, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of a conflict between these Terms and the Apple EULA, these Terms govern as between you and us; the Apple EULA governs as between you and Apple.
All organization and association names referenced in the App and in this document — including the Society of Accredited Marine Surveyors (SAMS), the National Association of Marine Surveyors (NAMS), the U.S. Coast Guard, and any classification society — belong to their respective holders. HullNote is not affiliated with, endorsed by, or connected to any of them.
We may update these Terms from time to time. Material changes will be surfaced in the App on next launch. Continued use of the App after a change constitutes acceptance.
These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles. Disputes will be resolved in courts located in California, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.
