Improvory Terms of Service

1. Acceptance

By downloading or using Improvory (the "App"), you agree to these Terms of Service. If you do not agree, do not use the App. The App is published by an independent iOS developer (Apple Developer Team ID ZM8LF8494F); references to "we," "us," and "our" mean that developer.

2. What Improvory is — and what it is not

Improvory is a personal recordkeeping tool for homeowners. You enter information about your home and about each improvement you make to it. The App organizes that information into a timeline, groups improvements by IRS Publication 523 category, sums the dollar amounts you enter (by category and overall), provides plain-English reference content, optionally adds reminder dates to your iPhone Calendar, and generates a Capital Improvements Summary PDF for your own use.

Improvory is NOT tax software and NOT a financial service. It does not calculate your taxes, your capital gain, or your cost basis; it does not apply any exclusion to your figures; it does not give tax advice; and it does not process payments or connect to any bank or financial account. The only arithmetic the App performs is summing the amounts you type in. For any tax determination, consult a CPA, Enrolled Agent, or tax professional, and refer to IRS Publication 523 (free at irs.gov). The App does not guarantee that any record will be accepted by the IRS, a tax professional, or a court.

3. Subscriptions and the Pro tier

3.1 Free tier

The App is free to download and use, with the following limits: 1 home, up to 8 improvements, and a preview of the improvement-vs-repair reference. App Lock is included free for all users.

3.2 Pro tier

Pro features unlock when you start the Pro subscription or complete the Lifetime purchase. Two products are offered:

Pro Annual — $19.99 per year, with a 7-day free trial for first-time subscribers.
Pro Lifetime — $49.99 one-time, non-consumable in-app purchase, no auto-renewal.

Both products unlock the identical Pro feature set. Prices shown are USD; Apple displays the equivalent local price at purchase time. There is no monthly product.

3.3 Auto-renewal and billing (Annual only)

The Annual subscription automatically renews until canceled. Renewal is charged within 24 hours before the end of the current period unless auto-renewal is turned off at least 24 hours before that end. Payment is charged to your Apple ID. You can manage and cancel your subscription in Settings > [your name] > Subscriptions on your iOS device. Refunds for the unused portion of an active period are not offered by us; refund eligibility is determined solely by Apple under its published policies. The Lifetime purchase is a single charge with no recurring billing.

3.4 Free trial forfeiture

If you start the 7-day free trial on Annual and cancel during the trial, you keep Pro access through the end of the trial and are not charged. If you do not cancel, your subscription begins at the end of the trial at the published price.

4. Pro features

Pro provides the following features. The behavior described here is binding on us — if a future App update materially changes any of these descriptions, we will revise this section.

Pub 523 improvement ledger: Pro subscribers may record an unlimited number of improvements and organize them by IRS Publication 523 categories. All entries are user-supplied and stored locally; the app does not classify, verify, or characterize them for tax purposes.
Documented-investment total: The app sums only the dollar amounts you enter, by category and overall. It does NOT calculate your cost basis, your capital gain, or any tax, and it does not apply any exclusion to your figures.
Capital Improvements Summary PDF: Files are generated on-device by PDFKit from data you entered. The document is a self-maintained record to provide to your tax professional and is NOT an IRS form or a calculation of your basis, gain, or tax. No data is transmitted during generation. Every page carries the reference-only disclaimer.
Improvement vs repair reference: Reference content is general information drawn from publicly available IRS resources (such as Publication 523, free at irs.gov). It is not tax advice and does not characterize your specific improvements; consult a CPA, Enrolled Agent, or tax professional.
Warranty & permit reminders: Tracks user-entered warranty and permit dates with local reminders via UserNotifications and optional Calendar events via EventKit. The app does not contact any contractor, municipality, or agency.
Widget: Rendered on-device by WidgetKit. It reads only the data you have already entered, via an App Group shared container. No network calls are made.

4.1 App Lock (Free)

App Lock is a Free feature that uses Apple's LocalAuthentication framework (Face ID, Touch ID, or device passcode) to gate access to the App. Biometric data never leaves Apple's Secure Enclave; the App receives only a success/failure result. App Lock can be enabled or disabled in Settings > Privacy at any time.

5. Your responsibilities

You are responsible for the accuracy of every value, date, amount, and category you record.
You are responsible for keeping your actual receipts and source documents; Improvory stores only the records you type in, not the underlying files.
You are responsible for maintaining iOS Backups (iCloud Backup or Finder/iTunes) so that your records survive device loss. Improvory has no remote copy of your data and cannot restore it.
You will not use the App as a substitute for a CPA, Enrolled Agent, tax attorney, or the IRS. You will consult those entities and IRS Publication 523 for any binding tax determination.

6. Disclaimers and limitation of liability

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the App is limited to the amount you paid us, through Apple, for the App in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost data, missed warranty or permit deadlines, tax outcomes, or any financial result. Reference content and totals are tools for your use; we do not guarantee that any tax professional, the IRS, or a court will accept or be bound by them.

7. Apple End User License Agreement

Your use of the App is also governed by Apple's standard End User License Agreement (EULA) for licensed applications, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of a conflict between these Terms and the Apple EULA, these Terms govern as between you and us; the Apple EULA governs as between you and Apple.

8. Trademarks

All product, organization, and agency names referenced in the App and in this document — including but not limited to the U.S. Internal Revenue Service (IRS) and IRS Publication 523 — belong to their respective holders. Improvory is not affiliated with, endorsed by, or connected to any listed entity.

9. Changes to these terms

We may update these Terms from time to time. Material changes will be surfaced in the App on next launch. Continued use of the App after a change constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles. Disputes will be resolved in courts located in California, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.
