Leverty — Terms of Service

1. Acceptance

By downloading or using Leverty (the "App"), you agree to these Terms of Service. If you do not agree, do not use the App. The App is published by an independent iOS developer (Apple Developer Team ID ZM8LF8494F); "we," "us," and "our" mean that developer.

2. What Leverty is — and what it is not

Leverty is a personal recordkeeping and reference tool for small-business owners who have received a business personal property assessment notice from a county assessor. You enter information about your own business assets (name, acquisition date, category, status, and an optional acquisition cost), the assessment notice (assessment year, assessed value, field office, appeal deadline), and your own dispute notes. The App organizes that record, tracks the short appeal deadline, references publicly available state business-personal-property and county appeals-board procedure material, and — on the Pro tier — generates an evidence-timeline PDF and an appeal-preparation checklist for your own use.

Leverty is not affiliated with, endorsed by, or connected to any county assessor, tax authority, or government agency, and it is not affiliated with any tax-consulting, appraisal, law, or accounting firm. It uses no government logo or mark. It does not connect to any bank or financial account; it does not calculate property tax, tax owed, or any tax saving (acquisition cost and assessed value are stored and displayed only and never participate in any calculation); it does not value your assets; it does not decide whether an assessment is correct or predict the outcome of an appeal; and it files nothing on your behalf and submits records to no government system. The App does not provide legal, tax, or accounting advice. You must pursue any appeal through your county's official assessment-appeal process, and you should verify the assessment and that process with your county assessment appeals board and, where appropriate, a licensed property tax consultant.

3. Subscriptions and the Pro tier

3.1 Free tier

The App is free to download and use, with these limits: up to 10 business assets (each with its category and status flag) and 1 assessment notice (with its assessed value, field office, and appeal deadline), dispute-point and ghost-asset flagging on every record, the state business-personal-property and appeals-board reference, and a single on-device reminder before your appeal deadline. App Lock (Face ID / Touch ID) is included free for all users.

3.2 Pro tier

Pro features unlock when you start the Pro subscription or complete the Lifetime purchase. Two products are offered:

Both products unlock the identical Pro feature set. Prices are in USD; Apple displays the equivalent local price at purchase. There is no monthly product.

3.3 Auto-renewal and billing (Annual only)

The Annual subscription automatically renews until canceled. Renewal is charged within 24 hours before the end of the current period unless auto-renewal is turned off at least 24 hours before that end. Payment is charged to your Apple ID. Manage or cancel in Settings > [your name] > Subscriptions on your iOS device. We do not offer refunds for the unused portion of an active period; refund eligibility is determined solely by Apple under its published policies. The Lifetime purchase is a single charge with no recurring billing.

3.4 Free trial forfeiture

If you start the 7-day free trial on Annual and cancel during the trial, you keep Pro access through the end of the trial and are not charged. If you do not cancel, your subscription begins at the end of the trial at the published price.

4. Pro features

Pro provides the following features. The behavior described here is binding on us — if a future App update materially changes any of these descriptions, we will revise this section.

4.1 App Lock (Free)

App Lock is a Free feature that uses Apple's LocalAuthentication framework (Face ID, Touch ID, or device passcode) to gate access to the App. Biometric data never leaves Apple's Secure Enclave; the App receives only a success/failure result. App Lock can be enabled or disabled in Settings > Privacy at any time.

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the App is limited to the amount you paid us, through Apple, in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost data, a missed appeal deadline, an increased or unreduced assessment, a higher tax bill, business interruption, or any outcome of an assessment, appeal, hearing, or proceeding. Reference content and generated documents are tools for your use; we do not guarantee that any assessor, appeals board, or court will accept or be bound by them.

7. Apple End User License Agreement

Your use of the App is also governed by Apple's standard End User License Agreement for licensed applications, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. If these Terms conflict with the Apple EULA, these Terms govern as between you and us; the Apple EULA governs as between you and Apple.

8. Trademarks

Organization and agency names referenced in the App and in this document — including county assessors and assessment appeals boards, state taxing authorities, and the U.S. Small Business Administration (SBA) — belong to their respective holders. Leverty is not affiliated with, endorsed by, or connected to any of them.

9. Changes to these terms

We may update these Terms from time to time. Material changes will be surfaced in the App on next launch. Continued use after a change constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles. Disputes will be resolved in courts located in California, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.
