Marksworth Terms of Service

1. Acceptance

By downloading or using Marksworth (the "App"), you agree to these Terms of Service. If you do not agree, do not use the App. The App is published by an independent iOS developer (Apple Developer Team ID ZM8LF8494F); "we," "us," and "our" mean that developer.

2. What Marksworth is — and what it is not

Marksworth is a personal record-keeping and reference tool for U.S. owners of federally registered trademarks. You enter information about your own marks and your own use of them in commerce. The App organizes that information by goods/services class and use type, tracks statutory maintenance deadlines (the Section 8 declaration, the Section 8/9 renewal, and the Section 15 incontestability window), lets you record challenges to a mark, provides a bundled plain-language reference on the Lanham Act and USPTO/TTAB procedure, and can generate a continuous-use evidence PDF for your own use.

Marksworth is not affiliated with, endorsed by, or connected to the USPTO, the TTAB, INTA, or any trademark law firm or filing service. It is not a law firm and provides no legal representation. It does not provide legal advice, does not determine whether a mark has been abandoned, does not predict TTAB outcomes, and does not file anything with the USPTO. It connects to no USPTO system and to no cloud. You must file and maintain your registration through the USPTO's official process, and you must verify all current requirements and deadlines with a trademark attorney or the USPTO. Trademark law and maintenance requirements change over time.

3. Subscriptions and the Pro tier

3.1 Free tier

The App is free to download and use, with the following limits: one trademark with up to ten dated use-in-commerce entries (without specimen photos), the full Lanham Act / USPTO / TTAB reference library, the Challenge Log, and every maintenance deadline shown with a single advance reminder each. App Lock is included free for all users.

3.2 Pro tier

Pro features unlock when you start a Pro subscription. Two products are offered:

Both products unlock the identical Pro feature set. Prices shown are USD; Apple displays the equivalent local price at purchase time.

3.3 Auto-renewal and billing

Each subscription automatically renews until canceled. Renewal is charged within 24 hours before the end of the current period unless auto-renewal is turned off at least 24 hours before that end. Payment is charged to your Apple ID. You can manage and cancel your subscription in Settings > [your name] > Subscriptions on your iOS device. Refunds for the unused portion of an active period are not offered by us; refund eligibility is determined solely by Apple under its published policies.

3.4 Free trial forfeiture

If you start the 14-day free trial on Annual and cancel during the trial, you keep Pro access through the end of the trial and are not charged. If you do not cancel, your subscription begins at the end of the trial at the published price.

4. Pro features

Pro provides the following features. The behavior described here is binding on us — if a future App update materially changes any of these descriptions, we will revise this section.

4.1 App Lock (Free)

App Lock is a Free feature that uses Apple's LocalAuthentication framework (Face ID, Touch ID, or device passcode) to gate access to the App. Biometric data never leaves Apple's Secure Enclave; the App receives only a success/failure result. App Lock can be enabled or disabled in Settings > Privacy at any time.

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the App is limited to the amount you paid us, through Apple, for the App in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost data, missed maintenance deadlines, abandonment or cancellation of a registration, loss of trademark rights, or any TTAB, USPTO, or litigation outcome. Reference content and deadline calculations are tools for your use; we do not guarantee that the USPTO, the TTAB, or any court will accept or be bound by them.

7. Apple End User License Agreement

Your use of the App is also governed by Apple's standard End User License Agreement (EULA) for licensed applications, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of a conflict between these Terms and the Apple EULA, these Terms govern as between you and us; the Apple EULA governs as between you and Apple.

8. Trademarks

All organization and agency names referenced in the App and in this document — including the United States Patent and Trademark Office (USPTO), the Trademark Trial and Appeal Board (TTAB), and the International Trademark Association (INTA) — belong to their respective holders. Marksworth is not affiliated with, endorsed by, or connected to any listed entity.

9. Changes to these terms

We may update these Terms from time to time. Material changes will be surfaced in the App on next launch. Continued use of the App after a change constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles. Disputes will be resolved in courts located in California, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.
