Pendwrit Terms of Service

1. Acceptance

By downloading or using Pendwrit (the "App"), you agree to these Terms of Service. If you do not agree, do not use the App. The App is made by an independent iOS developer (Apple Developer Team ID ZM8LF8494F); "we," "us," and "our" refer to that developer.

2. What Pendwrit is — and what it is not

Pendwrit is a personal recordkeeping tool for a person whose USCIS application has been pending past the normal processing time. You enter facts about your own case — form type, receipt date, the normal processing time you note, and a timeline of events such as RFEs, inquiries, CIS Ombudsman requests, and congressional contacts. The App organizes those facts, shows how long you have waited against the normal time you entered, surfaces general reference about USCIS processing and the mandamus procedure, optionally adds a milestone to your calendar, and can generate a delay-evidence PDF and a mandamus prep checklist for your own use.

Pendwrit is not affiliated with, endorsed by, or connected to USCIS, DHS, any government agency, any immigration-services organization, or any law firm. It uses no government logo or mark, submits records to no government system, and asks for no government identifier. It does not provide legal advice, does not determine whether any delay is legally "unreasonable," does not predict the outcome of any legal action, and does not recommend attorneys. It is solely for documenting civil administrative processing delay and has no enforcement-related purpose. For anything binding on your case, consult a licensed immigration attorney; the official USCIS Case Status tool, the CIS Ombudsman, and your congressional representative's casework office remain free resources.

3. Subscriptions and the Pro tier

3.1 Free tier

The App is free to download and use, with these limits: one case (with its receipt date, delay timeline, processing-time gap, and up to ten delay events) and the full USCIS-process and mandamus reference. App Lock is included free for everyone.

3.2 Pro tier

Pro features unlock when you start the Pro subscription or complete the Lifetime purchase. Two products are offered:

Both products unlock the identical Pro feature set. Prices shown are in USD; Apple displays the local equivalent at purchase. There is no monthly product.

3.3 Auto-renewal and billing (Annual only)

The Annual subscription renews automatically until canceled. Renewal is charged within 24 hours before the current period ends unless auto-renewal is turned off at least 24 hours before that point. Payment is charged to your Apple ID. Manage or cancel in Settings > [your name] > Subscriptions on your iOS device. We do not issue refunds for the unused portion of a period; refund eligibility is determined solely by Apple under its policies. The Lifetime purchase is a single charge with no recurring billing.

3.4 Free-trial forfeiture

If you start the 7-day Annual trial and cancel during it, you keep Pro access through the end of the trial and are not charged. If you do not cancel, the subscription begins at the end of the trial at the published price.

4. Pro features

Pro provides the following features. The behavior described here binds us — if a future update materially changes any of these descriptions, we will revise this section.

4.1 App Lock (Free)

App Lock is a free feature using Apple's LocalAuthentication framework (Face ID, Touch ID, or device passcode) to gate access to the App. Biometric data never leaves Apple's Secure Enclave; the App receives only a success or failure result. Toggle it in Settings > Privacy at any time.

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the App is limited to the amount you paid us, through Apple, for the App in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost data, a missed deadline, or any outcome of an administrative process or legal action. Reference content and the gap calculation are tools for your use; we do not guarantee that any agency, attorney, or court will accept or be bound by them.

7. Apple End User License Agreement

Your use of the App is also governed by Apple's standard End User License Agreement (EULA) for licensed applications, at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. If these Terms and the Apple EULA conflict, these Terms govern between you and us; the Apple EULA governs between you and Apple.

8. Trademarks and references

Agency and organization names referenced in the App or this document — including USCIS, DHS, the CIS Ombudsman, and AILA — belong to their respective holders. Pendwrit is not affiliated with, endorsed by, or connected to any of them, and references them only as publicly available points of information.

9. Changes to these terms

We may update these Terms from time to time. Material changes will be surfaced in the App on next launch. Continued use after a change constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles. Disputes will be resolved in courts located in California, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.
