RoadPact Terms of Service

1. Acceptance

By downloading or using RoadPact (the "App"), you agree to these Terms of Service. If you do not agree, do not use the App. The App is published by Flint Software, an independent iOS developer (Apple Developer Team ID ZM8LF8494F); "we," "us," and "our" mean that developer.

2. What RoadPact is — and what it is not

RoadPact is a personal recordkeeping tool for the volunteers who manage shared private roads in the United States — private road maintenance associations and shared-driveway groups. You enter information about your road, its parcels and owners, assessments, maintenance work, and meetings. The App helps you organize that information, splits a maintenance cost across parcels by frontage, equal share, or usage, references publicly available state private-road statutes, optionally adds reminders to your iPhone Calendar, and generates a records PDF for your own use.

RoadPact is NOT legal advice and NOT a substitute for a licensed attorney. The records, calculations, and PDFs it creates are NOT a legally recorded Private Road Maintenance Agreement, easement, or any binding legal document. RoadPact does NOT process payments, connect to any bank or payment service, or move money — assessment amounts and paid/unpaid statuses are recordkeeping only. RoadPact is NOT affiliated with any town, county, road commission, department of transportation, or county registry. To create or enforce a road maintenance agreement, consult a licensed real-estate attorney and record the agreement with your county. Cost-sharing rules vary by state and by your specific recorded agreement; verify with an attorney.

3. Subscriptions and the Pro tier

3.1 Free tier

The App is free to download and use, with the following limits: 1 road, up to 4 parcels, a basic maintenance log, one assessment calculation, and a next-meeting reminder.

3.2 Pro tier

Pro features unlock when you start a Pro subscription or complete the Lifetime purchase. Two products are offered:

Pro Annual — $14.99 per year, with a 7-day free trial for first-time subscribers.
Pro Lifetime — $39.99 one-time, non-consumable in-app purchase, no auto-renewal.

Both products unlock the identical Pro feature set. Prices shown are USD; Apple displays the equivalent local price at purchase time.

3.3 Auto-renewal and billing (Annual only)

The Annual subscription automatically renews until canceled. Renewal is charged within 24 hours before the end of the current period unless auto-renewal is turned off at least 24 hours before that end. Payment is charged to your Apple ID. You can manage and cancel your subscription in Settings > [your name] > Subscriptions on your iOS device. Refunds for the unused portion of an active period are not offered by RoadPact; refund eligibility is determined solely by Apple under its published policies. The Lifetime purchase is a single charge with no recurring billing.

3.4 Free trial forfeiture

If you start the 7-day free trial on Annual and cancel during the trial, you keep Pro access through the end of the trial and are not charged. If you do not cancel, your subscription begins at the end of the trial at the published price.

4. Pro features

Pro provides the following features. The behavior described here is binding on us — if a future App update materially changes any of these descriptions, we will revise this section.

Assessment calculator: A rule-based allocation that splits a total across parcels by frontage, equal share, or usage. It is a recordkeeping tool, not a tax, legal, or financial calculation.
Shared-cost ledger: Records assessment amounts, per-parcel shares, and a paid / unpaid status. RoadPact does not process payments, connect to any bank or payment service, or move money.
Meeting minutes and vote records: Optional minutes, attendees, motions, vote tallies, and decisions stored locally with the road record.
Maintenance log: Optional maintenance events with type, date, vendor, cost, and notes, stored locally. Cost totals are informational only.
Records PDF packet: Generated on-device by PDFKit and handed to the iOS Share Sheet. No record content is transmitted. The PDF is for the user's own organization and is not a legally recorded agreement.
Unlimited roads and parcels: Pro removes the free-tier limit of 1 road and 4 parcels.
State road-law reference: Plain-language reference notes drawn from publicly available state statutes and codes. Reference-only and not legal advice.
Widgets: Rendered by Apple's WidgetKit on the device, reading only data you have already entered, via an App Group shared container. No network calls.

4.1 App Lock (Free)

App Lock is a Free feature that uses Apple's LocalAuthentication framework (Face ID, Touch ID, or device passcode) to gate access to the App. Biometric data never leaves Apple's Secure Enclave; the App receives only a success/failure result. App Lock can be enabled or disabled in Settings > Privacy at any time.

5. Your responsibilities

You are responsible for the accuracy of every value, frontage, amount, and record you enter, and for any decision your association makes from them.
You are responsible for maintaining iOS Backups (iCloud Backup or Finder/iTunes) so your records survive device loss. RoadPact has no remote copy of your data and cannot restore it. There is no in-app data export, import, or backup feature beyond records-PDF generation.
You will not use the App as a substitute for an attorney, an accountant, or your county registry, and you will consult those professionals for any binding determination.
You will collect and settle any money your association owes through your own arrangements; RoadPact only records the amounts.

6. Disclaimers and limitation of liability

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the App is limited to the amount you paid us, through Apple, for the App in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost data, neighbor disputes, missed deadlines, financing or sale outcomes, tax outcomes, or any cost-sharing dispute. Reference content and calculations are tools for your use; we do not guarantee that any lender, agency, or court will accept or be bound by them.

7. Apple End User License Agreement

Your use of the App is also governed by Apple's standard End User License Agreement (EULA) for licensed applications, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of a conflict between these Terms and the Apple EULA, these Terms govern as between you and us; the Apple EULA governs as between you and Apple.

8. Trademarks

All organization and agency names referenced in the App and in this document belong to their respective holders. RoadPact is not affiliated with, endorsed by, or connected to any listed entity.

9. Changes to these terms

We may update these Terms from time to time. Material changes will be surfaced in the App on next launch. Continued use of the App after a change constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles. Disputes will be resolved in courts located in California, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.
