TrustSteward — Terms of Service

These Terms of Service (the “Terms”) govern your use of TrustSteward (the “App”), an iPhone records organizer for Special Needs Trust administration, ABLE account documentation, SSI / Medicaid asset limit evidence, and Letter of Intent succession planning. By installing or using the App you accept these Terms. If you do not accept them, do not install or use the App.

1. Reference only — not legal, tax, or benefit advice

TrustSteward is a personal records organizer. It is not a special needs attorney, elder law attorney, financial planner, accountant, fiduciary trustee, disability advocate, or government benefits worker. The App does not provide legal advice, tax advice, or determination of SSI / Medicaid eligibility. The App does not suggest specific trust structures, does not recommend specific attorneys (only directs you to attorney referral networks such as the Special Needs Alliance and the Academy of Special Needs Planners), does not calculate tax implications, and does not predict the outcome of any SSI or Medicaid claim or appeal.

2. UPL boundary (Unauthorized Practice of Law)

Trust administration software has been the subject of state bar UPL enforcement actions. TrustSteward operates inside a strict reference-only boundary. The Reference Mapper engine surfaces rule-based deterministic categories drawn from publicly available U.S. government regulations and program documentation. Every Reference Mapper suggestion includes a directive to consult a licensed special needs attorney. For all legal, tax, and benefit decisions, you agree to consult a licensed special needs attorney, elder law attorney, accountant, or your state’s Protection & Advocacy (P&A) system.

3. Subscriptions and one-time purchases

The Free tier of TrustSteward includes:

TrustSteward Pro is an optional annual auto-renewing subscription at $39.99 / year with a 7-day free trial. Lifetime is an optional one-time non-renewing purchase at $199. Either unlock all Pro features:

4. Auto-renewal, cancellation, and refunds (annual subscription)

The annual subscription renews automatically at the end of each year unless you cancel through your Apple ID at least 24 hours before the renewal date. The 7-day free trial converts to a paid year automatically unless canceled at least 24 hours before the trial ends. Refunds for App Store purchases are handled by Apple under their standard refund policy. We do not process refunds directly.

5. Local-only storage and data loss

All records you create in TrustSteward are stored on your iPhone. The App does not include built-in data export, import, or backup features. Your records are included in standard iOS Backups (iCloud Backup or Finder backups) when those are enabled. If you delete the App without an iOS Backup available, your records will be permanently lost. You acknowledge that on-device storage and the iOS Backup mechanism are the recovery path.

6. PDF reports and the iOS Share Sheet

The App generates PDF Reports on your iPhone. The iOS Share Sheet is the App’s only egress channel for those PDFs (AirDrop, Mail, Files, Messages, third-party apps the user has installed). Any further distribution is your responsibility.

7. Limitation of liability

The App is provided “as is” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, Flint Software shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or relating to your use of the App. Records you organize using the App are your sole responsibility. The App is not a substitute for the records-of-record maintained by the SSA, IRS, CMS, Medicaid, your state ABLE plan administrator, your trust attorney, or your accountant.

8. Non-affiliation

TrustSteward is not affiliated with the Social Security Administration, IRS, CMS, Medicaid, ABLE National Resource Center, Special Needs Alliance, Academy of Special Needs Planners, The ARC, National Disability Rights Network, Disability Rights Education and Defense Fund, Center for Public Representation, or any government agency, attorney network, or advocacy organization. Each named organization holds its own trademark.

9. Changes to these Terms

We may update these Terms from time to time. The revised version will be posted at the same URL. Continued use of the App after an update indicates acceptance of the revised Terms.

10. Governing law

These Terms are governed by the laws of the United States. Any dispute arising out of or relating to these Terms or your use of the App will be resolved in the federal or state courts located in the United States.
