WaitForecast Terms of Service

1. Acceptance of these terms

By downloading or using WaitForecast (the "App"), you agree to these Terms of Service. If you do not agree, do not use the App. References to "we," "us," and "our" in this document mean the App's publisher; for any question, contact captainlongevity@gmail.com.

2. What WaitForecast is, and is not

WaitForecast is an iPhone reference and statistical projection tool for U.S. Visa Bulletin priority dates. You enter a visa category (one of EB-1, EB-2, EB-3, F1, F2A, F2B, F3, F4) and a country of chargeability; the App presents the current cutoff date from the most recent Visa Bulletin and a rule-based statistical projection over the past 24 months of Bulletin movement. The App also starts an ActivityKit Live Activity that counts down to the next expected Bulletin release on the Lock Screen and, on iPhone 14 Pro and later, in the Dynamic Island.

WaitForecast is not an immigration attorney, a paralegal, an immigration case management service, a USCIS form preparation service, a legal advice service, an immigration tracker, or an immigration policy advocacy organization. The App does not advise on case strategy, recommend visa category switches or cross-chargeability strategy, predict whether a priority date will become current by any specific date, predict approval or denial for any individual case, recommend specific immigration attorneys, draft USCIS forms, or guarantee the accuracy of any projection for your specific facts. Bulletin movement is influenced by allocation policy, processing throughput, and per-country caps in ways that historical regression cannot fully model. 3. Immigration UPL boundary — what the App will not do

Immigration practice is regulated under federal law and state bar UPL rules. The App is structured to stay on the reference and projection side of that boundary. Specifically, the App will never:

The App displays the Visa Bulletin as the U.S. Department of State publishes it. The App takes no position on per-country cap policy, H.R. 1044, S. 386, EAGLE Act, RELIEF Act, or any pending or historical immigration legislation, and does not characterize cap allocations as fair or unfair. The Tone Guide enforced across the App's user-facing copy, Live Activity strings, and notifications uses a formal-legal voice precisely because the legitimacy of the App's reference-only positioning depends on neutrality.

5. Subscription products

5.1 Free tier

The App is free to download and use, with the following limits in version 1.0:

Three products unlock the same Pro feature set:

Prices shown are USD; Apple displays the equivalent local price at purchase time. Annual and Monthly belong to a single subscription group so that you can move between them without a subscription change fee; Lifetime is a separate non-consumable IAP.

5.3 Auto-renewal and billing (Annual and Monthly)

The Annual and Monthly subscriptions automatically renew until canceled. Renewal is charged within 24 hours before the end of the current period unless auto-renewal is turned off at least 24 hours before that end. Payment is charged to your Apple ID. You can manage and cancel your subscription in Settings > [your name] > Subscriptions on your iOS device. Refunds for the unused portion of an active period are not offered by WaitForecast; refund eligibility is determined solely by Apple under its published policies. The Lifetime purchase is a single charge with no recurring billing.

5.4 Free trial mechanics (Annual only)

If you start the 7-day free trial and cancel during the trial, you keep Pro access through the end of the trial and are not charged. If you do not cancel before the trial ends, your subscription begins at the published Annual price.

Pro provides the following features. The behavior described here is binding on us — if a future App update materially changes any of these descriptions, we will revise this section.

8. Disclaimers and limitation of liability

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. Visa Bulletin movement is influenced by allocation policy, USCIS and consular processing throughput, country caps, and political circumstances; historical regression cannot fully model these factors and any projection is a reference range only. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the App is limited to the amount you paid us, through Apple, for the App in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including missed filing deadlines, expired status, lost work authorization, denied I-485 applications, family separation, or any immigration outcome. Reference data and projection ranges are tools for your use; we do not guarantee that USCIS, the Department of State, the National Visa Center, or any consular officer will accept or be bound by them.

9. Apple End User License Agreement

Your use of the App is also governed by Apple's standard End User License Agreement for licensed applications, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of a conflict between these Terms and the Apple EULA, these Terms govern as between you and us; the Apple EULA governs as between you and Apple.

10. Trademarks and non-affiliation

All organization, agency, product, and statute names referenced in the App or in this document — including but not limited to the Department of State Visa Bulletin, U.S. Citizenship and Immigration Services, the Executive Office for Immigration Review, the National Visa Center, the Department of Labor, the American Immigration Lawyers Association (AILA), the Catholic Legal Immigration Network (CLINIC), VECINA, the Northwest Immigrant Rights Project (NWIRP), ASISTA, the International Rescue Committee (IRC), the Council on American-Islamic Relations (CAIR), the American Immigration Council, the Immigration and Nationality Act (INA), Apple, ActivityKit, WidgetKit, StoreKit, and SwiftData — belong to their respective holders. WaitForecast is not affiliated with, endorsed by, or connected to any listed entity.

11. Changes to these terms

We may update these Terms from time to time. Material changes will be surfaced in the App on next launch. Continued use of the App after a change constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles. Disputes will be resolved in courts located in California, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.
