By downloading or using Wardwell (the "App"), you agree to these Terms of Service. If you do not agree, do not use the App. The App is published by an independent iOS developer (Apple Developer Team ID ZM8LF8494F); "we," "us," and "our" mean that developer.
Wardwell is a personal record-keeping and reference tool for a family member documenting a possible problem with a court-appointed adult guardian or conservator. You enter your own observations. The App organizes that information, lets you add a ward, log concerns, track the accountings a conservator is required to file against statutory deadlines, keep a communication log, browse publicly available per-state guardianship procedure content, optionally attach your own photos, and generate a Guardianship Oversight PDF for your own use.
The App is free to download and use, with the following scope: add a ward and run the full oversight log; record up to 10 concern entries across every concern type; keep a communication log; and browse each state's guardianship law, accounting requirements, removal procedure, and the free help named throughout. App Lock is included free for all users.
Pro features unlock when you start either Pro subscription. Two auto-renewing products are offered in a single subscription group:
Both products unlock the identical Pro feature set. Prices shown are USD; Apple displays the equivalent local price at purchase time.
Each subscription automatically renews until canceled. Renewal is charged within 24 hours before the end of the current period unless auto-renewal is turned off at least 24 hours before that end. If you start the Annual product's 14-day free trial, you are not charged until the trial ends, and you may cancel during the trial to avoid any charge. Payment is charged to your Apple ID. You can manage and cancel your subscription in Settings > [your name] > Subscriptions on your iOS device. Refunds for the unused portion of an active period are not offered by us; refund eligibility is determined solely by Apple under its published policies.
Pro provides the following features. The behavior described here is binding on us — if a future App update materially changes any of these descriptions, we will revise this section.
App Lock is a Free feature that uses Apple's LocalAuthentication framework (Face ID, Touch ID, or device passcode) to gate access to the App. Biometric data never leaves Apple's Secure Enclave; the App receives only a success/failure result. App Lock can be enabled or disabled in Settings > Privacy at any time.
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the App is limited to the amount you paid us, through Apple, for the App in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost data, missed deadlines, court outcomes, guardianship or conservatorship decisions, harm to any ward, or any other result. Reference content is a tool for your use; we do not guarantee that any court, agency, or hearing body will accept or be bound by anything produced with the App.
Your use of the App is also governed by Apple's standard End User License Agreement (EULA) for licensed applications, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of a conflict between these Terms and the Apple EULA, these Terms govern as between you and us; the Apple EULA governs as between you and Apple.
All court, agency, and company names referenced in the App and in this document belong to their respective holders. Wardwell is not affiliated with, endorsed by, or connected to any listed entity.
We may update these Terms from time to time. Material changes will be surfaced in the App on next launch. Continued use of the App after a change constitutes acceptance.
These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles. Disputes will be resolved in courts located in California, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.
