By downloading or using WellKept (the "App"), you agree to these Terms of Service. If you do not agree, do not use the App. The App is published by an independent iOS developer (Apple Developer Team ID ZM8LF8494F); references to "we," "us," and "our" mean that developer.
WellKept is a personal recordkeeping and reminder tool for owners of a private water well. You enter information about your well and about each water test you run. The App organizes that information, shows each result next to publicly available EPA or state action levels as a factual comparison, schedules retest reminders, logs maintenance events, provides plain-English reference content, and generates a Well Water Records PDF for your own use.
The App is free to download and use, with the following limits: 1 well, up to 3 tests, and 1 retest reminder, plus a preview of the contaminant reference. App Lock is included free for all users.
Pro features unlock when you complete the Lifetime purchase or start the Pro subscription. Two products are offered:
Both products unlock the identical Pro feature set. Prices shown are USD; Apple displays the equivalent local price at purchase time. There is no monthly product.
The Annual subscription automatically renews until canceled. Renewal is charged within 24 hours before the end of the current period unless auto-renewal is turned off at least 24 hours before that end. Payment is charged to your Apple ID. You can manage and cancel your subscription in Settings > [your name] > Subscriptions on your iOS device. Refunds for the unused portion of an active period are not offered by us; refund eligibility is determined solely by Apple under its published policies. The Lifetime purchase is a single charge with no recurring billing.
If you start the 7-day free trial on Annual and cancel during the trial, you keep Pro access through the end of the trial and are not charged. If you do not cancel, your subscription begins at the end of the trial at the published price.
Pro provides the following features. The behavior described here is binding on us — if a future App update materially changes any of these descriptions, we will revise this section.
App Lock is a Free feature that uses Apple's LocalAuthentication framework (Face ID, Touch ID, or device passcode) to gate access to the App. Biometric data never leaves Apple's Secure Enclave; the App receives only a success/failure result. App Lock can be enabled or disabled in Settings > Privacy at any time.
The Home Screen "next test due" widget is also Free. It is rendered on-device by WidgetKit and reads only the data you have already entered, via an App Group shared container. No network calls are made.
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the App is limited to the amount you paid us, through Apple, for the App in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost data, missed retest reminders, health outcomes, or any decision made about your water. Reference content and comparisons are tools for your use; we do not guarantee that any buyer, lender, health department, or court will accept or be bound by them.
Your use of the App is also governed by Apple's standard End User License Agreement (EULA) for licensed applications, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of a conflict between these Terms and the Apple EULA, these Terms govern as between you and us; the Apple EULA governs as between you and Apple.
All product, organization, and agency names referenced in the App and in this document — including but not limited to the U.S. Environmental Protection Agency (EPA), the U.S. Centers for Disease Control and Prevention (CDC), and any state agency — belong to their respective holders. WellKept is not affiliated with, endorsed by, or connected to any listed entity.
We may update these Terms from time to time. Material changes will be surfaced in the App on next launch. Continued use of the App after a change constitutes acceptance.
These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles. Disputes will be resolved in courts located in California, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.
