Accepting these terms
By downloading or using AtelierRecords (the "App"), you agree to these Terms of Service. If you do not agree, do not use the App. The App is published by an independent iOS developer (Apple Developer Team ID ZM8LF8494F); references to "we," "us," and "our" mean that developer.
Scope: what the app does, and what it does not do
AtelierRecords is a personal records organizer for UHNW private collectors of fine art and decorative art. You enter information about your pieces, provenance chains, acquisitions and disposals, appraisal history, condition reports, beneficiary designations, insurance policies and itemized schedules, and provider documents; the App helps you organize that information and (in the Plus tier) generate PDF reports for your own use, including an Insurance Schedule, Provenance Pack, Due Diligence Reference Report, Estate Inventory Pack, IRS Form 8283 Companion, and Comprehensive Collection Archive.
AtelierRecords is not appraisal, legal, conservation, insurance, tax, or estate-planning advice. It does not perform appraisals, generate legal opinions, make claims about whether a specific piece is looted art or whether a specific dealer or owner is culpable, query any due diligence database, calculate insurance underwriting outcomes, predict IRS Form 8283 acceptance, recommend beneficiary structure, or guarantee any auction sale, restitution, insurance, tax, or estate-distribution result. Provenance gap flags (including the Nazi-era 1933-1945 flag) are rule-based computations on dates and ranges and are reference-only. Due diligence references (Art Loss Register, IFAR, German Lost Art Foundation, US Holocaust Memorial Museum, Washington Conference Principles 1998, UNESCO 1970 Convention) are pointer-only text and URL strings; the App does not query any of those resources. PDF reports generated by the App are personal records; they are not official appraisals, legal opinions, insurance documentation, or government filings. For appraisal, consult an AAA-, ASA-, or ISA-certified appraiser. For Nazi-era due diligence, consult art world legal counsel. For conservation, consult an AIC-certified conservator. For estate planning, consult an estate attorney. For tax matters, consult a CPA or tax attorney. For insurance underwriting, consult your insurance broker. AtelierRecords is not affiliated with any auction house, art insurance carrier, due diligence database, appraisal organization, conservation organization, or government agency.
How Plus works
3.1 Free tier
The App is free to download and use. The free tier includes 1 piece with basic info (artist, title, medium, dimensions, date created), up to 4 photos per piece (front, reverse, detail, installation), the 8 medium categories and 9 location types, and Face ID / Touch ID app lock. Records are stored on your device only. Your archive is protected from device loss by Apple's standard device backup (iCloud Backup or iTunes / Finder).
3.2 Plus subscription
Plus features unlock when you start a Plus subscription or purchase the Plus Lifetime product. Two products are offered:
- Plus Yearly — $39.99 per year, with a 30-day free trial for first-time subscribers.
- Plus Lifetime — $299 one-time non-consumable purchase.
Both products unlock the same set of Plus features. Prices shown are USD; Apple displays the equivalent local price at purchase time.
3.3 Auto-renewal and billing (Annual)
The auto-renewing Annual subscription automatically renews until canceled. Renewal is charged within 24 hours before the end of the current period unless auto-renewal is turned off at least 24 hours before that end. Payment is charged to your Apple ID. You can manage and cancel your subscription in Settings > [your name] > Subscriptions on your iOS device. Refunds for the unused portion of an active period are not offered by AtelierRecords; refund eligibility is determined solely by Apple under its published policies.
3.4 Free trial forfeiture (Annual)
If you start a free trial and cancel during the trial, you keep Plus access through the end of the trial period and are not charged. If you do not cancel, your subscription begins at the end of the trial at the published price.
3.5 No cloud storage
AtelierRecords stores all records on your device only. The App does not use iCloud sync, CloudKit, or any cloud storage operated by us or any third party. Records are protected from device loss by Apple's standard device backup (iCloud Backup or iTunes / Finder), which includes the App's data when you enable it — that backup is operated by Apple under your Apple ID, not by us.
3.6 Plus Lifetime (one-time purchase)
Plus Lifetime is a non-consumable in-app purchase. There is no recurring charge. The purchase unlocks the same Plus feature set as the Annual subscription and persists for the life of the App on every device signed into your Apple ID. Refunds are governed solely by Apple under its published policies.
What unlocks at Plus
Plus provides the following features. The behavior described here is binding on us — if a future App update materially changes any of these descriptions, we will revise this section.
- Unlimited pieces: Plus subscribers may track an unlimited number of pieces across all medium categories.
- Provenance Chain Builder: A structured editor for the complete ownership timeline of each piece. Entries are user-supplied and stored locally with the piece. The chain you record is not a substitute for due diligence research conducted by art world legal counsel, an AAA-certified appraiser, or an auction house provenance specialist.
- Due Diligence Reference Tool: Surfaces reference resources for pre-1945 pieces with provenance gaps spanning 1933-1945. References include Art Loss Register, IFAR, German Lost Art Foundation, US Holocaust Memorial Museum Provenance Research Resources, Washington Conference Principles 1998, UNESCO 1970 Convention, and the US Cultural Property Implementation Act. The tool performs no API calls and makes no claims about provenance legitimacy, title, restitution obligation, or any specific piece, dealer, or owner. Detection of a Nazi-era ownership gap is rule-based (gap date range intersects 1933-01-30 to 1945-05-08 for a piece created before 1945) and is reference-only. For due diligence determination, consult art world legal counsel.
- Insurance Schedule Manager: Generates itemized scheduled-item lists formatted to match Lloyd's of London, AXA Art (XL Catlin), Chubb Masterpiece, Berkley Asset Protection, and AIG Private Client Group conventions. Generation runs on-device from local records. We are not affiliated with any insurer. Your insurance broker remains the authoritative source for underwriting requirements.
- Six PDF reports: Insurance Schedule, Provenance Pack (single piece), Due Diligence Reference Report, Estate Inventory Pack, IRS Form 8283 Companion, Comprehensive Collection Archive. All reports are generated on-device from local records. No data is transmitted during generation. Reports are personal organizational tools, not official appraisals, legal opinions, insurance documentation, or government filings.
- Appraisal history: Per-piece appraisal log with date, appraiser, credential, purpose, value, and validity period (default 5 years). Expiration dates are computed locally. The app does not perform appraisals and is not a substitute for an AAA-, ASA-, or ISA-certified appraiser.
- Condition Report Log: Per-piece inspection records with inspector type, overall condition, specific issues, conservation treatment notes, and photographic documentation. Stored locally with the piece. The log is not a substitute for a condition report prepared by an AIC-certified conservator or an auction house condition specialist.
- Estate Legacy Planner: Per-piece beneficiary designations, wishes documentation, tax basis, and IRS Form 8283 status. Informational only; not estate-planning advice. Consult an estate attorney for legal effect.
The following capabilities are universal Free (never gated):
- App lock (Face ID / Touch ID): Uses Apple's LocalAuthentication framework. Biometric data never leaves Apple's Secure Enclave; the app receives only a success/failure result. Privacy is the brand promise; the lock is never sold.
- Per-piece Markdown share: From any piece's detail page, "Share as Markdown" produces a plain-text file containing the piece's basic fields, provenance entries (if any), appraisals (if any), and acquisitions (if any), exchanged via the iOS Share Sheet. Available to every user regardless of subscription so users can always extract their own data from the app.
- The 8 medium categories and 9 location types.
- The 5-section Disclaimer (surfaced during onboarding with must-acknowledge checkbox and on every generated PDF).
- Basic single-piece editing with up to 4 photos.
What you commit to
- You are responsible for the accuracy of every record, value, photo, attribution, provenance entry, and condition note you enter.
- You are responsible for consulting qualified professionals for decisions AtelierRecords does not make: an AAA-, ASA-, or ISA-certified appraiser for valuation; art world legal counsel for due diligence determination; an AIC-certified conservator for conservation; an estate attorney for estate planning; a CPA or tax attorney for tax matters; your insurance broker for underwriting requirements. AtelierRecords is not a substitute for any of those professionals.
- You are responsible for maintaining iCloud or iTunes device backups so that archive data survives device loss. AtelierRecords has no remote copy on our servers and cannot restore data we never received.
- You will not use the App for any purpose other than personal documentation of your own collection records (or records you are otherwise lawfully entitled to maintain on behalf of a person or estate for whom you provide service).
Disclaimers and liability
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the App is limited to the amount you paid us, through Apple, for the App in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost data, denied insurance underwriting, denied claims, restitution outcomes, lost auction sales, lost charitable-contribution tax deductions, estate-distribution disputes, or any financial or legal outcome. Reports generated by the App are tools for your use; we do not guarantee that any insurer, appraiser, auction house, conservator, attorney, accountant, family office, or government agency will accept them.
The Apple EULA also applies
Your use of the App is also governed by Apple's standard End User License Agreement (EULA) for licensed applications, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of a conflict between these Terms and the Apple EULA, these Terms govern as between you and us; the Apple EULA governs as between you and Apple.
Future revisions
We may update these Terms from time to time. Material changes will be surfaced in the App on next launch. Continued use of the App after a change constitutes acceptance.
Governing law and venue
These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles. Disputes will be resolved in courts located in California, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.
