1. Acceptance of these terms

By downloading or using FacilityLog (the "App"), you agree to these Terms of Service. If you do not agree, do not use the App. The App is published by an independent iOS developer (Apple Developer Team ID ZM8LF8494F); references to "we," "us," and "our" mean that developer.

2. What FacilityLog is — and is not

FacilityLog is a personal records organizer for adult children tracking a parent's or other loved one's long-term care facility experience — nursing home, assisted living, memory care, independent living, or continuing care retirement community placement. You enter information about facilities, residents, incidents, call logs, billing disputes, care plan meetings, and attached documents; the App helps you organize that information and (in the Pro tier) generate PDF reports for your own use, including an Ombudsman Complaint Pack, a State AG Complaint Pack, a State Survey / CMS Complaint Pack (nursing-home only), a Civil Litigation Evidence Pack, and a Care Plan vs Reality Audit Report.

FacilityLog is not legal advice, medical advice, advocacy advice, or insurance advice. It does not diagnose conditions, recommend treatments, detect abuse patterns, generate complaint letters, generate ombudsman submissions, generate attorney filings, or guarantee any complaint or litigation outcome. Incident types and severity ratings you record are your own self-characterizations and are not substitutes for clinician-confirmed adverse event reporting. PDF reports generated by the App are personal records; they are not official ombudsman submissions, official CMS or state survey complaints, formal legal filings, or legal evidence collected under counsel. For medical decisions, consult your physician. For appeal-related or facility-dispute-related legal matters, consult an elder-law attorney. For ombudsman services, contact your state Long-Term Care Ombudsman program. FacilityLog does not report elder abuse, neglect, or exploitation to Adult Protective Services, law enforcement, or any agency on your behalf. Many U.S. states have mandatory reporter laws requiring certain individuals to report suspected elder abuse. You are responsible for understanding and complying with your state's mandatory reporting obligations. FacilityLog is not affiliated with Brookdale Senior Living, Sunrise Senior Living, Atria Senior Living, Five Star Senior Living, Genesis HealthCare, Ensign Group, or any nursing home, assisted living, memory care, or continuing care retirement community. It is not affiliated with CMS, HHS, state Long-Term Care Ombudsman programs, AARP, the National Consumer Voice for Quality Long-Term Care, the American Health Care Association, LeadingAge, or any government agency, professional organization, or advocacy group.

3. Subscriptions and the Pro tier

3.1 Free tier

The App is free to download and use. The free tier includes 1 facility, up to 15 incident records per facility with all 21 incident-type categories, up to 3 call log entries per facility, up to 3 billing dispute entries per facility, up to 3 care plan meetings per facility, 1 photo per incident, per-incident Markdown export, a basic chronological timeline view, and Face ID / Touch ID app lock (universal Free — privacy is the brand promise and the lock is never sold). Records are stored on your device only. Your archive is protected from device loss by Apple's standard device backup (iCloud Backup or Finder).

3.2 Pro subscription

Pro features unlock when you start a Pro subscription or purchase the Pro Lifetime product. Three products are offered:

3.3 Auto-renewal and billing (Monthly + Annual)

Auto-renewing subscriptions (Monthly and Annual) automatically renew until canceled. Renewal is charged within 24 hours before the end of the current period unless auto-renewal is turned off at least 24 hours before that end. Payment is charged to your Apple ID. You can manage and cancel your subscription in Settings > [your name] > Subscriptions on your iOS device. Refunds for the unused portion of an active period are not offered by FacilityLog; refund eligibility is determined solely by Apple under its published policies.

3.4 Free trial forfeiture (Annual)

If you start a free trial and cancel during the trial, you keep Pro access through the end of the trial period and are not charged. If you do not cancel, your subscription begins at the end of the trial at the published price.

3.5 No cloud storage

FacilityLog stores all records on your device only. The App does not use iCloud sync, CloudKit, or any cloud storage operated by us or any third party. Records are protected from device loss by Apple's standard device backup (iCloud Backup or Finder), which includes the App's data when you enable it — that backup is operated by Apple under your Apple ID, not by us. Pro users can additionally export the entire archive as a JSON file from Settings > Privacy and Backup > Export Archive Now for portable offline backup. The Family Archive Export feature (Pro) generates a read-only JSON file for sharing with up to three family members through your own iCloud Drive shared folder; file transfer is performed by iOS Files and iCloud Drive, not by us.

3.6 Pro Lifetime (one-time purchase)

Pro Lifetime is a non-consumable in-app purchase. There is no recurring charge. The purchase unlocks the same Pro feature set as the auto-renewing subscriptions and persists for the life of the App on every device signed into your Apple ID. Refunds are governed solely by Apple under its published policies.

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the App is limited to the amount you paid us, through Apple, for the App in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost data, denied insurance claims, denied facility complaints, wrongful eviction outcomes, denied APS or ombudsman investigations, or any clinical, financial, or legal outcome. Reports generated by the App are tools for your use; we do not guarantee that any ombudsman, state survey agency, state Attorney General office, civil court, attorney, advocate, or facility will accept them.

7. Apple End User License Agreement

Your use of the App is also governed by Apple's standard End User License Agreement (EULA) for licensed applications, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of a conflict between these Terms and the Apple EULA, these Terms govern as between you and us; the Apple EULA governs as between you and Apple.

8. Changes to these terms

We may update these Terms from time to time. Material changes will be surfaced in the App on next launch. Continued use of the App after a change constitutes acceptance.

9. Governing law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles. Disputes will be resolved in courts located in California, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.
