HOAGuard Terms of Service

1. Acceptance of these terms
By downloading or using HOAGuard (the "App"), you agree to these Terms of Service. If you do not agree, do not use the App. The App is published by an independent iOS developer (Apple Developer Team ID ZM8LF8494F); references to "we," "us," and "our" mean that developer.
2. What HOAGuard is — and is not
HOAGuard is a personal documentation tool for homeowners who are tracking a dispute with their Homeowners Association. You enter information about violation notices, fines, photographs, communications, meetings, and appeals that pertain to your own property; the App helps you organize that information and generate reports for your own use, including a PDF evidence package you may share with your attorney or a hearing officer.
HOAGuard is not a law firm and does not provide legal advice. We do not represent you in any proceeding, appear at hearings, advise on the merits of your dispute, or draft formal legal documents on your behalf. The HOA Rights Reference Guide included in the App is general educational content sourced from publicly available legal education materials; it is not legal advice for your specific situation. All interpretations of your CC&Rs, your HOA's conduct, your jurisdiction's statutes, and the strength of your case are your responsibility. Always consult a licensed attorney in your state for advice specific to your dispute.
3. Subscriptions and the Pro tier
3.1 Free tier
The App is free to download and use with the following limits: 1 property / 1 HOA, up to 3 violation notices, up to 3 photos per violation, the Home dashboard fine total, response deadline reminders, and the full HOA Rights Reference Guide.
3.2 Pro subscription
Pro features unlock when you start a Pro subscription. Two products are offered:
- Pro Annual — $29.99 per year, with a 7-day free trial for first-time subscribers.
- Pro Monthly — $4.99 per month, no trial.
Both products unlock the same set of Pro features. Prices shown are USD; Apple displays the equivalent local price at purchase time.
3.3 Auto-renewal and billing
Subscriptions automatically renew until canceled. Renewal is charged within 24 hours before the end of the current period unless auto-renewal is turned off at least 24 hours before that end. Payment is charged to your Apple ID. You can manage and cancel your subscription in Settings > [your name] > Subscriptions on your iOS device. Refunds for the unused portion of an active period are not offered by HOAGuard; refund eligibility is determined solely by Apple under its published policies.
3.4 Free trial forfeiture
If you start a free trial and cancel during the trial, you keep Pro access through the end of the trial period and are not charged. If you do not cancel, your subscription begins at the end of the trial at the published price.
4. Pro features
Pro provides the following features. The behavior described here is binding on us — if a future App update materially changes any of these descriptions, we will revise this section.
- Selective enforcement evidence: Comparison entries linked to a violation, with optional GPS coordinates captured on-device via Core Location. GPS data is stored locally with the entry; no location data is transmitted.
- Unlimited violation notices: Pro subscribers may log an unlimited number of violation notices per property. The Free tier is limited to three.
- Evidence package PDF: Generates a PDF document on-device using PDFKit. No violation, photo, or personal data is transmitted during generation. The footer of every PDF includes the legal disclaimer.
- Unlimited appeals per violation: Records appeal method, argument summary, documents attached, outcome, and timeline. The Free tier allows one appeal per violation; Pro removes the cap. Local storage only.
- Fine ledger: Categorized fine tracking with charts rendered on-device via Swift Charts. No financial data is transmitted.
- Unlimited communication log: Logs channel, direction, summary, screenshots, and links to related violations. The Free tier allows up to five communication entries; Pro removes the cap. Stored locally; screenshots never leave the device.
- Board meeting notes: Records meeting type, attendees, discussions, user's questions, board responses, and votes. Local storage only.
- Architectural request tracker: Records ARB project description, CC&R section, status, and response. Local storage only.
- Widget: Reads from the local App Group container only. No network reads.
- CSV export: Files generated on-device. No record content is transmitted during export.
The following capabilities are available to all users (Free and Pro) and are listed here so the privacy and storage characteristics are part of these binding Terms:
- Key contacts directory: Names, roles, phones, emails are stored locally with the property record and are not synced to the device's Contacts app.
- Face ID / Touch ID app lock: Uses LocalAuthentication. Biometric data never leaves Apple's Secure Enclave; the app receives only a success/failure result.
- Per-violation Markdown summary share: Generates a single-violation Markdown text file on-device and offers it to the system share sheet. No record content is transmitted during generation; what happens after you choose a destination (Mail, Files, AirDrop, etc.) is governed by that destination's terms.
5. Your responsibilities
- You are responsible for the accuracy of every date, amount, description, photograph, and note you enter.
- You are responsible for maintaining device backups (iCloud or iTunes) so that your documentation survives device loss. HOAGuard has no remote copy of your data and cannot restore it.
- You will use the App only to document a dispute pertaining to property you own or are otherwise lawfully entitled to represent. You will not use the App to harass, stalk, or unlawfully surveil any person, including board members, neighbors, management-company employees, or other homeowners.
- Photographs of neighboring properties for selective-enforcement comparison must be taken from public property or from property where you have a lawful right to be, and must not depict individuals in contexts where they have a reasonable expectation of privacy. You are solely responsible for compliance with your jurisdiction's photography, trespass, and privacy laws.
6. Disclaimers and limitation of liability
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the App is limited to the amount you paid us, through Apple, for the App in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost data, adverse dispute outcomes, fines upheld, or attorney's fees incurred. Reports generated by the App are tools for your use; we do not guarantee that any HOA board, hearing officer, mediator, arbitrator, or court will accept them as evidence.
7. Apple End User License Agreement
Your use of the App is also governed by Apple's standard End User License Agreement (EULA) for licensed applications, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of a conflict between these Terms and the Apple EULA, these Terms govern as between you and us; the Apple EULA governs as between you and Apple.
8. Changes to these terms
We may update these Terms from time to time. Material changes will be surfaced in the App on next launch. Continued use of the App after a change constitutes acceptance.
9. Governing law
These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles. Disputes will be resolved in courts located in California, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.
