Zerk Terms of Service

1. Acceptance

By downloading or using Zerk (the "App"), you agree to these Terms of Service. If you do not agree, do not use the App. The App is published by an independent iOS developer (Apple Developer Team ID ZM8LF8494F); "we," "us," and "our" mean that developer.

2. What Zerk is — and what it is not

Zerk is a personal recordkeeping tool for the machines you own — cars, trucks, motorcycles, and hour-based small engines such as mowers, generators, and boats. You enter your own readings, service jobs, fuel fills, and specs. The App learns each machine's usage rate, projects when each service task is due across miles, engine hours, and months, keeps a per-machine Garage Card of the specs you record, totals what doing your own work has saved you, and generates a Service History PDF you can share.

Zerk stores your own records. It does not provide repair instructions, torque values, capacities, or factory maintenance schedules, and it is not affiliated with any vehicle or equipment manufacturer, parts supplier, or agency. Suggested intervals are editable defaults you set from your own manual, not authoritative factory data. The MPG heads-up is a hedged, diagnostic-free hint about your own fuel numbers, not a fault diagnosis or repair recommendation. You are responsible for how you maintain your machines; consult your manual and a qualified mechanic for any binding decision.

3. Subscriptions and the Pro tier

3.1 Free tier

The App is free to download and use, with these limits: 2 machines; unlimited fuel and service logs; the Garage Card core sections per machine; the whichever-first projection engine on up to 5 service tasks total; a 60-day analytics window; 20 photos; and per-machine CSV export. Quick logging and projections are never gated.

3.2 Pro tier

Pro features unlock when you complete any one of three purchases, which unlock the identical feature set and differ only in billing:

3.3 Auto-renewal and billing (Yearly and Monthly)

The Yearly and Monthly subscriptions automatically renew until canceled. Renewal is charged within 24 hours before the end of the current period unless auto-renewal is turned off at least 24 hours before that end. Payment is charged to your Apple Account. You can manage or cancel a subscription in Settings > [your name] > Subscriptions on your iOS device. Refunds for the unused portion of an active period are not offered by us; refund eligibility is determined solely by Apple under its published policies. The Lifetime purchase is a single charge with no recurring billing.

3.4 Free trial forfeiture

If you start the 7-day free trial on the Yearly subscription and cancel during the trial, you keep Pro access through the end of the trial and are not charged. If you do not cancel, the subscription begins at the end of the trial at the published price. The Monthly and Lifetime products have no trial.

4. Pro features

Pro provides the following features. The behavior described here is binding on us — if a future App update materially changes any of these descriptions, we will revise this section.

6. Disclaimers and limitation of liability

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the App is limited to the amount you paid us, through Apple, for the App in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost data, missed maintenance, mechanical failure, breakdown, resale outcomes, or any repair cost. Projections, intervals, and MPG hints are tools for your use; we do not guarantee their accuracy or that any buyer, mechanic, or third party will accept or rely on them.

7. Apple End User License Agreement

Your use of the App is also governed by Apple's standard End User License Agreement (EULA) for licensed applications, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of a conflict between these Terms and the Apple EULA, these Terms govern as between you and us; the Apple EULA governs as between you and Apple.

8. Trademarks

All manufacturer, vehicle, equipment, and parts names you may enter or see referenced belong to their respective holders. Zerk is not affiliated with, endorsed by, or connected to any of them.

9. Changes to these terms

We may update these Terms from time to time. Material changes will be surfaced in the App on next launch. Continued use of the App after a change constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles. Disputes will be resolved in courts located in California, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.
